These Terms & Conditions (“Terms”) govern your access to and use of the Elbo Books website, products, and related services (collectively, the “Services”). The Services are provided by Elbo Software, LLC, a Wyoming limited liability company (“Elbo,” “we,” “our,” or “us”).

By placing an order, submitting content, or using any part of the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Overview of Our Service

Elbo Books are personalized physical activity books for children. To create a book, you may provide information about the child (such as age and interests) and upload photos to be transformed into illustrated characters. After you complete checkout, we design the book using a combination of AI-assisted tools, proprietary Elbo software, and human review. Books are printed and fulfilled by our third-party print-on-demand partner and shipped to addresses within the United States.

We may revise, discontinue, or modify products, formats, features, or options (for example, cover types, page counts, activity types, or designs) at any time without prior notice, provided that changes will not affect orders that we have already accepted.

2. Eligibility

You may place an order only if:

  • You are at least 18 years old and capable of entering into a binding contract; or

  • You are a parent or legal guardian acting on behalf of a minor.

By ordering, you represent that all information you submit is accurate.

3. Use of the Site

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Use the Services in any way that violates applicable law or the rights of others.

  • Attempt to gain unauthorized access to any systems, networks, or data.

  • Interfere with or disrupt the operation or security of the Services.

  • Use the Services to send any malicious code, spam, or harmful content.

We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms or used the Services improperly.

4. Your Content and License to Us

To create your personalized book, you may submit photos, text (such as inscriptions), and form responses (“User Content”).

You retain ownership of your User Content. However, by submitting it, you grant Elbo a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, transform, edit, and create derivative works from the User Content solely for the purpose of creating, printing, and delivering your book and for any customer support you request.

We may edit, adapt, crop, or omit parts of your submitted information or content as needed to create your book in a safe, legal, and appropriate manner (for example, to correct minor issues, remove unsuitable references, or fit layout constraints).

We do not use your photos or identifiable User Content for marketing.

We may use non-identifiable excerpts of generated pages (for example: puzzle layouts, illustrations that do not depict your child’s recognizable likeness, and generic artwork) for marketing or promotional purposes.

You represent and warrant that:

  • You own or have permission to use all User Content you submit.

  • Your User Content does not infringe or violate any third-party rights, including copyrights, trademarks, or privacy rights.

  • Your User Content complies with the restrictions below.

5. Prohibited Content

To protect children, comply with the law, and ensure we can ethically produce your book, you may not submit any User Content (including photos or stated interests) that is:

  • Illegal, harmful, or abusive.

  • Pornographic, sexual, or suggestive involving minors.

  • Violent, hateful, or discriminatory.

  • IP-restricted (for example, “Mickey Mouse,” “Taylor Swift,” or other trademarked/franchised characters, celebrities, or branded media).

  • Misleading, fraudulent, or submitted without permission.

  • Unusable for book creation (for example, unclear photos with many people and no indication of which is the child, extremely low-resolution images, or unrelated photos).

We reserve the right, in our sole discretion, to:

  • Reject or request clarification or resubmission of User Content;

  • Edit, adapt, crop, or omit parts of User Content that we consider inappropriate, unusable, or IP-restricted while proceeding with acceptable parts; and

  • Cancel an order that cannot be completed in a compliant or appropriate way, in which case we will refund amounts you paid for that order.

6. Book Creation Process

Our process involves:

  • AI-assisted generation;

  • Proprietary Elbo software; and

  • Human review of every page before printing.

While we strive for accuracy and quality, occasional imperfections can occur in generative content (for example, puzzles that turn out unsolvable or illustrations that do not fully match expectations). By using the Services, you acknowledge that minor imperfections are possible.

We also work with physical printing processes. Colors and print quality may vary slightly from what you see on your screen due to differences in devices, screens, and printing methods. We do not guarantee an exact color or appearance match between on-screen previews or samples and printed books.

7. Orders, Pricing, Payment, and Order Acceptance

Pricing. All prices are listed in USD and exclude taxes and shipping unless otherwise stated. Taxes and shipping fees will be shown at checkout.

We may change prices, promotions, and shipping fees at any time before you place an order. Once you submit an order and payment is accepted, the price for that order is locked in.

Payment. Payments are processed securely through Shopify and its payment providers. Elbo Software, LLC does not store or have access to full payment card numbers.

Order Confirmation and Acceptance. When you submit an order, you may receive an email acknowledging receipt of your order. This acknowledgment confirms that we received your order but does not guarantee acceptance. We reserve the right to reject or cancel any order, for example in cases of:

  • Suspected fraud or misuse;

  • Inappropriate or IP-restricted User Content that cannot be remedied;

  • Operational issues or inability to fulfill the order;

  • Discontinuation or unavailability of a product, component, or feature needed for your order.

We accept your order when we begin production of your book or send a shipping confirmation. If we cancel an order after you have been charged, we will refund the amount you paid for that order.

No Cancellations or Changes by Customer. Once an order is placed and payment is completed, it cannot be changed or canceled by you, as personalization work may begin immediately. You may contact support@elbobooks.com and we will do our best to accommodate changes, but we do not guarantee them.

8. Shipping, Delivery, and Risk of Loss

We currently ship only within the United States.

Estimated Timelines (Not Guarantees).

  • Printing: approximately 5–11 business days.

  • Shipping: approximately 2–10 business days after printing, depending on the shipping option selected.

These timelines are estimates, not guarantees. Actual delivery times may vary based on carrier performance, weather, holidays, carrier disruptions, or other factors outside our control. We are not liable for delays caused by carriers or other circumstances beyond our reasonable control.

Risk of Loss and Title. Title and risk of loss for Products pass to you when we deliver your book to the shipping carrier. Once the book is in the carrier’s possession, loss, theft, or damage in transit is generally the responsibility of the carrier and/or you, subject to any replacement commitments we describe in these Terms.

Please make sure you provide an accurate shipping address and are available to receive deliveries. If a package is returned to us due to an incorrect address or failure to accept delivery, we may require additional shipping fees to resend it or may cancel the order and refund you the product price (less any unrecoverable shipping costs), at our discretion.

9. Returns, Replacements, and Damaged Items

Because each book is uniquely personalized, we do not accept returns or offer refunds, except where required by law.

If your book arrives damaged or misprinted, notify us within 1 month of delivery at support@elbobooks.com. We may request a photograph of the issue. You may keep the damaged book, and we will replace it at no cost if we confirm the damage or defect.

We do not provide cash refunds for personalized books unless we are unable to reasonably produce a replacement.

10. Data Retention and Deletion

We use Tally to receive form submissions (including uploaded photos) and Notion to manage non-photo order data. Data is also processed within our internal systems and by our print and fulfillment partners.

We generally retain User Content only as long as needed to create and deliver your book:

  • For completed orders: we aim to delete photos within approximately 30 days after book completion.

  • For incomplete orders or abandoned personalizations: we aim to delete photos within approximately 30–60 days.

These timeframes are targets and may vary due to operational constraints. We may retain archived copies of certain data as required for legal, tax, or security purposes.

11. Intellectual Property

All original content created by Elbo (including generated illustrations, puzzles, layouts, background art, software, workflows, and book designs) is the exclusive property of Elbo Software, LLC.

By purchasing a book, you receive a physical copy for personal, non-commercial use only. You may not:

  • Reproduce the book (beyond normal personal use).

  • Resell or publish its contents.

  • Distribute digital scans of substantial parts of the book.

  • Use generated content for commercial purposes.

12. Third-Party Services

We rely on third parties to operate the Services, including:

  • Shopify (checkout, order management, customer accounts, payments);

  • Tally (form submissions and temporary storage of uploaded photos);

  • Notion (order fulfillment management for text input only);

  • A print-on-demand partner (printing and shipping);

  • Shipping carriers (delivery).

Your use of those components may also be subject to the third parties’ own terms and privacy policies. We are not responsible for their acts or omissions.

We do not operate or manage “customer accounts” hosted by Shopify. If you choose to use Shopify’s customer account features, your use of those features is governed by Shopify’s own terms of service and privacy policy.

13. Disclaimers

To the fullest extent permitted by law:

  • The Services are provided “as is” without warranties of any kind, whether express or implied.

  • We do not guarantee specific creative outcomes, educational benefits, or perfect accuracy in generated content.

  • We do not guarantee that every puzzle, activity, or page will be error-free or match your expectations in every detail.

  • Printing and shipping timelines are estimates, not guarantees.

Some states do not allow certain warranty disclaimers, so these may not apply to you in full.

14. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.

  • Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law. Some states do not allow certain limitations, but the liability cap remains enforceable in most jurisdictions.

15. Indemnification

You agree to indemnify and hold harmless Elbo Software, LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your breach of these Terms;

  • Your User Content;

  • Your misuse of the Services.

16. Force Majeure

We will not be liable for any delay or failure to perform any obligation under these Terms to the extent the delay or failure is caused by an event or circumstance beyond our reasonable control, including but not limited to: acts of God; natural disasters; war; terrorism; riots; labor disputes or strikes; power or internet outages; failures of third-party service providers; governmental actions; epidemics or pandemics; or other events of a similar nature.

In such cases, our obligations will be suspended for the duration of the event, and we will resume performance as soon as reasonably practicable.

17. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Any dispute arising out of or relating to the Services must be brought in the state or federal courts located in Wyoming. You consent to the jurisdiction and venue of those courts.

18. Changes to the Terms and to the Services

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Services after any update constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

We may also modify, suspend, or discontinue any part of the Services, including products, features, or pricing, at any time without prior notice, provided that changes will not affect orders already accepted.

19. General Provisions

Entire Agreement. These Terms, together with any policies or documents expressly incorporated by reference (such as our Privacy Policy), constitute the entire agreement between you and Elbo regarding the Services and supersede any prior agreements.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
